- a. You can make a reference online to Arcwave or any of our Trade-marks to describe our products and services, but your reference must be truthful, and cannot suggest that you are affiliated or partnered with, approved, sponsored or endorsed by, WTC.
- b. Textual references to Arcwave or our other Trade-marks should never be hyperlinked to anything but the Arcwave.com home page or the specific Arcwave.com product page associated with the hyperlinked Trade-mark.

To be clear, the Trade-marks must not be incorporated or used in any manner as part of, or in close proximity to, another company's name, domain name/website, product or service name, logo, trade dress, design, slogan or other trade-marks. The Trade-marks must never appear with any other symbol or icon (except the trade-mark symbols ® or ™), be contained within a box, circle, or other shape, or combined with any other name, logo or icon to create a co-branded logo.

- g. Do not use trade-marks, logos, or other content that are confusingly similar to the Trade-marks.

- i. You may not attempt to get rights in the Trade-marks, or any confusingly similar approximations, whether by trade-mark registration, domain name registration or otherwise. In the event that you do acquire any unauthorized rights in or to any Trade-marks, you must promptly assign them to us without compensation.
- j. We require the use of either the ® or the ™ trade-mark attribution symbols with our Trade-marks.
User Accounts
To access some features of the Website, you may have to register for a Arcwave user account or partner account. When registering a user or partner account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your user or partner account. You must keep your account password secure. You must notify WTC immediately of any breach of security or unauthorized use of your user or partner account. Although WTC will not be liable for your losses caused by any unauthorized use of your user or partner account, you may be liable for the losses of WTC or others due to such unauthorized use.
All login names and passwords remain the property of WTC, and may be cancelled or suspended at any time by WTC without any notice or liability to you or any other person. WTC is not under any obligation to verify the actual identity or authority of the user of any login name or password.
By registering a user or partner account you give WTC permission to send you periodic information on sales and promotions.
By registering a partner account you acknowledge that you have agreed to the terms and conditions in our Arcwave Partner Agreement.
User Content: Privacy
In the Terms and Conditions, user content means material including, without limitation, text, images, audio material, video material and audio-visual material that you submit to this Website, for whatever purpose (collectively, "User Content"). You may be able to post or upload (in designated areas of the Website) User Content to the Website.
You represent and warrant that you own or have the rights to use and license WTC to use the User Content in the manner contemplated by the Website and the Terms and Conditions.
You are solely responsible for your own User Content and the consequences of posting or publishing it. This Website displays products available for purchase; however, not all products are available at all times and products may be changed, substituted or discontinued at any time. WTC attempts to provide an accurate description of the products available for sale, but does not warrant the accuracy, completeness, reliability or currency of such descriptions. While we use our best efforts to fulfill all orders, WTC cannot guarantee the availability of any particular product displayed on this Website. WTC reserves the right to discontinue the sale of any product listed on this Website at any time without notice.
Product Prices
Product prices offered on this Website may vary from other advertised prices due to varying conditions in different geographic markets. The prices displayed on this Website are quoted in CDN dollars or in US dollars depending on the jurisdiction from which you access this Website. Prices are valid and effective only within their respective Canadian or US jurisdictions, and such prices do not include shipping and handling (unless otherwise indicated) or sales taxes, if applicable, which will be added to your total invoice price. You are responsible for the payment of any shipping and handling charges and taxes that may apply to your order.
Payment Options
WTC accepts VISA and MasterCard credit cards. We do not accept cash, cheques or COD for online orders.
Delivery
WTC will use commercially reasonable efforts to deliver any ordered product as quickly as possible and within any time periods indicated. However, you acknowledge and agree that WTC will not be held responsible for any delays in shipping or delivery.
Warranties

Changes
WTC has the right at any time to make changes in drawings, specifications, materials, packaging, time and place of delivery, and method of transportation. You hereby agree to accept any such changes subject to this section.

While our goal is an error-free site, we do not guarantee that any content is 100% accurate or complete, including price information and product specifications. If we discover price errors, they will be corrected on our systems, and the corrected price will apply to your order. Unenforceable Provisions

Severability
If any term or provision of the Terms and Conditions, or the application thereof to any person, place or circumstance, shall be held by a court of competent jurisdiction or other competent authority to be invalid, unenforceable or void, the remainder of the Terms and Conditions and such term or provision as applied to other persons, places and circumstances shall remain in full force and effect.
Indemnity
You hereby indemnify WTC and undertake to keep WTC indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by WTC to a third party in settlement of a claim or dispute on the advice of WTC's legal advisers) incurred or suffered by WTC arising out of any breach by you of any provision of the Terms and Conditions, or arising out of any claim that you have breached any provision of the Terms and Conditions.
Breaches of the Terms and Conditions
Without prejudice to WTC's other rights under the Terms and Conditions, if you breach the Terms and Conditions in any way, WTC may take such action as WTC deems appropriate to deal with the breach, including suspending your access to the Website, prohibiting you from accessing the Website, blocking computers using your IP address from accessing the Website, contacting your Internet service provider to request that they block your access to the Website and/or bringing court proceedings against you.
Variation
WTC may revise the Terms and Conditions from time-to-time. Revised Terms and Conditions will apply to the use of this Website from the date of the publication of the revised terms and conditions on this Website. Please check this page regularly to ensure you are familiar with the current version.
Law, Jurisdiction and Language
Any matter that arises out of your use of this Website shall be governed by the laws of the Province of Ontario, in the country of Canada. All contracts shall be concluded in English.
Assignment
WTC may transfer, sub-contract or otherwise deal with WTC's rights and/or obligations under the Terms and Conditions without notifying you or obtaining your consent.
You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under the Terms and Conditions.
Entire Agreement
These Terms and Conditions constitute the entire agreement between WTC and you regarding the subject matter of this agreement, and supersede all prior or contemporaneous agreements or communications, whether electronic, oral or written between WTC and you with respect to such subject matter.
Accessible Customer Service Plan
WOW Tech Canada Ltd. (WTC) is committed to providing a work environment that is supportive of independence, dignity, integration and equal opportunity and remains diligent in ensuring the application of these same standards when dealing with contractors, customers, service providers and visitors to our offices.
WTC is committed to excellence in serving all customers, including people with disabilities. WTC strives to provide customers with disabilities the same opportunity to access our goods and services, so that they may benefit from them in a similar way as other customers. This will be achieved in the following ways:
Assistive Devices
We will serve people with disabilities who use assistive devices to obtain our goods and services by ensuring that our staff is trained and familiar with various assistive devices that may be used by customers.
Communication
We will communicate with people with disabilities in ways that take into account their disability. This will include training customer service representatives on how to interact and communicate with people with various types of disabilities.
Telephone Services
We will train our customer service representatives to communicate with customers over the telephone and to speak clearly in plain language. We will offer to work with a customer through email or other written correspondence if communicating by telephone is not suitable for them.
Web Services
Our website and webstore are accessible to all customers, including those who are visually challenged, through assistive programs such as JAWS screen reader. If a customer has difficulty navigating our webstore, our customer service representatives are trained to assist customers through the process.
Billing
We will provide invoices to all of our customers in a format that is suitable to them such as hard copy, large print, e-mail, etc. We will answer customer queries about the content of the invoice in person, by telephone or by email.
Service Animals
We welcome people with disabilities who are accompanied by a service animal in our premises. We will also ensure that all staff are properly trained on how to interact with people with disabilities who are accompanied by a service animal.
Support Persons
A person with a disability who is accompanied by a support person will be allowed to have that person accompany them on our premises. Our premises are our corporate offices and therefore there are no charges for customers to enter our premises.
Notice of Temporary Disruption
If there were a temporary disruption, notice would be posted on WTC websites where the majority of our customers access our services (Arcwave.com and www.standardinnovation.com). Very few customers visit our corporate offices. Notice would include information about the reason for the disruption, its anticipated length of time and alternative means for accessing our services.
Training for Staff
WOW Tech Canada Ltd. will provide training to all employees who deal with the public or other third parties on their behalf, and all those who are involved in the development and approvals of customer service policies, practices and procedures. This training will be provided in the Employee Orientation package that staff receives when hired.
Training will include the following:
- An overview of the Accessibility for Ontarians with Disabilities Act, 2005 and the requirements of the customer service standard
- WTC's plan related to customer service standard
- How to interact and communicate with people with various types of disabilities
- How to interact with people with disabilities who use an assistive device or require the assistance of a service animal or a support person
- Familiarize employees with personal assistive devices and train employees on how to use devices on premise, such as automatic doors, that may help with providing goods or services to people with disabilities
Staff will also be trained on these policies and procedures when changes are made to the plan.

Customer Service will receive all feedback, including complaints. Feedback will be directed to the appropriate Manager depending on the nature of or subject of the complaint. Customers can expect to hear back within five business days.
Modifications to This or Other Policies
Any policy of WTC that does not respect and promote the dignity and independence of people with disabilities will be modified or removed.
